India Signals Shift Toward a Dedicated AI Law

India's IT minister says the country needs a fresh AI-specific law, marking a departure from its light-touch stance as the RBI orders frontier-AI risk assessments and courts crack down on hallucinated citations.

India appears to be abandoning its long-held position that existing law is enough to govern artificial intelligence. Union Minister for Electronics and Information Technology Ashwini Vaishnaw indicated the government may pursue a dedicated statute, saying India needs a fresh AI-specific law because "the world of AI is very different from the world when the (Information Technology) Act was enacted in 2000."

The signals are stacking up

The ministerial comments cap a run of AI governance moves across Indian institutions:

  • The Reserve Bank of India gave banks and regulated entities until June 30 to submit board-approved gap assessments covering frontier-AI cyber risks.
  • The Supreme Court set aside tribunal orders built on AI-hallucinated precedents this month, demanding "zero tolerance" and directing the Bar Council to frame rules for AI in adjudication.
  • Prime Minister Modi, at VivaTech in June, framed the national posture as "for India, AI means all inclusive," stressing democratized access alongside the IndiaAI mission's sovereign compute and indigenous LLM programs.

Why it matters

India has been the most consequential holdout in Asia's regulatory wave — Vietnam passed the region's first AI law, Korea and Japan have frameworks in motion, and Singapore has operationalized agentic-AI governance. A binding Indian statute would put the world's most populous market, and its fastest-growing developer ecosystem, on the rules-based side of the ledger.

Timing remains unclear, and New Delhi has a history of long consultations. But the direction has visibly changed: the question is no longer whether India writes an AI law, but how strict it will be.
